Terms and Conditions

These are the General Terms and Conditions of Uppark, a general partnership, constituted according to Dutch legislation. Uppark is located at the Groot Egtenrayseweg 21 in Venlo – Blerick, The Netherlands. You can contact us via info@uppark.nl and on the following telephone number: +31 (0)77 3231570  (Monday to Friday, from 9am to 5pm). Uppark is registered at the Dutch Chamber of Commerce in Venlo under registration number 52892360. BTW (VAT) number is NL850651712B01. These conditions apply to all purchase and sale agreements concluded between Uppark and its customers via the web shop www.uppark.nl. When checking the box ‘’I agree to the General Terms and Conditions’’ during the ordering procedure, you declare that you agree with the content and that it applies to your agreement with Uppark. Orders cannot be placed without agreeing to the General Terms and Conditions.

Article 1 – Placing an order
You can place an order by clicking on all the desired products in the online store. If you want to order a product you can add it to your shopping bag. When you have finished shopping, go to the shopping bag and finish your order. Check the products placed in the shopping bag and select the desired mode of payment and shipment. If you have a discount code, you can fill this out and the discount will be automatically deducted. When you have already made a profile, you can log on immediately. If not, we ask you to make a personal profile first. Check the order again and agree to the General Terms and Conditions. Choose your desired mode of payment and finish your payment. You are now referred to a secure area to finish the financial transaction. After finishing your payment, you will receive a confirmation e-mail. The purchase agreement is concluded via this e-mail. The agreement is therefore considered to be concluded in the Netherlands. Uppark reserves the right to cancel and/or annul the transaction process, should we deem this necessary.

Article 2 – Payment
Advance payment can take place via iDEAL, Paypal or credit card (MasterCard and Visa). By using a certain credit card, you confirm that the credit card being used is yours. The amount due will be automatically debited to your account, provided that Uppark has accepted this order. All cardholders will be subjected to verifications and a consent to validate by the credit card company. Should your card-issuing institution refuse to allow payment to Uppark, we will delay the delivery and contact you. In this case, Uppark will not be held responsible for any delay or non-delivery. Credit card information is processed by means of an SSL (secure socket layer-) connection. Uppark will not be held responsible for misuse of this information by third parties.

The total amount stated on the order and on the electronic order form includes the shipping costs. All prices mentioned on the online store include BTW (VAT).

Article 3 – Delivery

The Netherlands
Uppark will try its best to send your order within a period of 2 working days. Uppark cannot be held liable, should the shipment take place at a later date. Uppark reserves the right to deliver the order up to 30 days after the order is placed and cannot be held liable by the customer. The customer will be informed should an order not be sent within 2 working days after placing an order.

Orders placed before 3pm from Monday to Friday are sent the same day. Orders placed on Friday evening, Saturday and Sunday are sent on Monday. When we have processed the order, you will receive an e-mail from PostNL. This e-mail contains a Track & Trace number which enables you to follow the package.

All packages are sent with PostNL. Packages are sent with signature for receipt home address (HVH)". This means that the package will not be delivered to your neighbours and you must personally sign for receipt.

It is possible that you are not at home when the package is delivered. When this is the case, PostNL will deliver the package the following day, except for Sundays. If you are not at home the second time, PostNL will leave a note in your letterbox stating where the package can be collected. Usually this is the nearest post office.

In the Netherlands no shipment costs will be charged for sending a package to your home address or returning a package from your home address for orders exceeding an amount of € 150.
For orders with an amount less than € 150, we have to charge a contribution in shipment costs of € 2.95.

Belgium and Germany
If you live in Belgium or Germany you can indicate this during the payment process.
In Belgium and Germany, we have to charge a contribution in shipment costs of € 4.95. Shipment costs for sending a package from your home address to Uppark are for your own account.

In Belgium and Germany, the package is delivered at your neighbour’s house if you are not at home.

Shipment costs when returning shoes from your home address to Uppark:
If you return shoes in order to exchange them for others, the shipment costs are for your own account.
If you return shoes and you wish to have a refund, shipment costs are for your own account.

In Belgium and Germany, the package is delivered at your neighbour’s house when you are not at home. Packages are sent with "signature for receipt".

All other countries

If you live in a country outside of the Netherlands, Belgium and Germany, you can indicate this
during the payment process.

Please indicate whether you live in “Other European Countries” (other than The Netherlands, Belgium and Germany) or in “Countries Outside Europe”.

In “Other European Countries” we have to charge a contribution in shipment costs of €10,- for sending a package to your home address. Shipment costs for sending a package from your home address to Uppark are for your own account, and will be deducted from the purchase amount to be refunded.

In “Countries Outside Europe” we have to charge a contribution in shipment costs of €20,- for sending a package to your home address. Shipment costs for sending a package from your home address back to Uppark are for your own account, and will be deducted from the purchase amount to be refunded.

It is possible that the postman delivers your package to your neighbour’s house when you are not at home.

If your county is not on the list or if you have any other question, please contact us and together we will discuss the possibilities.

The Netherlands

Returns
If you are not satisfied with your purchase, you can return it up to 14 days after delivery of the goods. The only thing you have to do is fully and correctly complete the form enclosed in the shoe box and place the enclosed return sticker over the shipping label. Take the package to the nearest post office.

Returned products are only accepted if:
1. The product is returned in the original packaging;
2. The product has not been used, damaged, worn or cleaned;
3. Labels are still attached to the product;
4. The instructions of use have been properly followed up.

Shoes can only be tried on indoors. If shoe soles are dirty, the return cannot be accepted. Any free products sent by Uppark must also be returned. Products that are returned outside the above-mentioned period can be sent back to the purchaser without reimbursement. All carefully returned products will be credited. Uppark will refund the paid amount minus possible shipping costs to the account number you have submitted within 10 days.

Exchanges
If you wish to exchange the product for a different product, another size or colour, you can indicate this on the attached return form. We ask you to send us an e-mail or contact customer service, so we can reserve the product for you. Shipping costs for exchanges are for the account of Uppark. If you wish to exchange a product a second time we ask for a contribution of € 4.95 to the shipping costs. When we receive the return package, you will receive a confirmation e-mail. If there is a price difference as a result from the exchange, you will receive an e-mail with a request for additional payment or you will receive the price difference on your account within 10 days. *Exchanges are only accepted if the Terms and Conditions mentioned above have been adhered to.

Belgium and Germany

Returns

Article 6 – Information on the web shop
The information on uppark.nl has been compiled with the utmost care and is constantly held up to date. However, we make no warranties of any kind about the nature of or information content on this website and in no event will we be liable for this information content or consequences of using the information content. We will not be held responsible or liable for the access to information on any website that is connected/linked to or with uppark.nl in any way. Nothing on this internet site creates any rights or obligations. Typographical errors and/or incorrect prices are reserved. The colour of the product can differ from the colour on your computer screen. Every computer screen is different, as are the screen settings. Of course, we will try our best to portray the true colour as well as possible.

Article 7 – Price policy with respect to sale
If you order a product at Uppark within 2 days before the sale starts, we will adjust the product's price. This does not apply to products already discounted or products to which an extra discount has been added at the cash register. All price adjustments approved by us, will be refunded to the account number with which you paid your order.

Article 8 – Liability
The purchaser's liability is limited to the amount of the purchase price. Uppark can never be held liable for any loss of profit or goodwill or any other consequential damages.

Article 9 – Applicable law and jurisdiction
Dutch legislation is applicable. Any dispute regarding a purchase and sale agreement to which these Terms and Conditions apply, will be exclusively brought to court at Venlo, unless general partnership Uppark chooses to bring the dispute to the authorized court in the purchaser's place of residence.

Article 10 – Complaints
If you have any complaints, please contact us by telephone on +31 (0)77 3231570 or send an e-mail to info@uppark.nl. If you send an e-mail, do not forget to include your personal details, your order number and a clear description of your complaint. If it is a complaint about a product, please include a digital photo. We will assess your complaint based on your description (and included photo) and we will contact you within 3 working days.
