Terms & Conditions

These are the General Conditions of V.O.F. Uppark, a General Partnership, established according to the laws of The Netherlands. Uppark is situated at Gassthuisstraat 22, Horst, The Netherlands. We can be contacted via grotesque@uppark.nl an by telephone on +31 (0)77 3231570 (from Monday to Friday from 9am to 5pm). Registered at the Chamber of Commerce at Venlo, registered number 52892360. BTW (VAT) number NL850651712B01. These conditions are applicable to all purchasing and selling agreements entered into by Uppark and its clients via the web shop www.grotesque.uppark.nl. On checking the box "I agree to the General Conditions" during step 3 of the ordering process, you declare that you agree with their contents and that they apply to your agreement with Uppark. No order can be placed without agreeing to the General Conditions.
 

Article 1 – Placing an order
You can place an order by clicking on the required products on the web shop. To order a product add it to your shopping bag. When you have finished shopping, go to the shopping bag and complete your order. Check the products placed and select a method of payment. If you already have a profile then you can sign in straight away. If not, then we ask you to make a personal profile. Check your order again and agree to the General Conditions. Choose your bank and complete your payment with iDEAL. If paying by credit card, complete your credit card details and click on pay. You will then be transferred to a secure environment to complete the financial transaction. After completing your payment your will receive an order confirmation via e-mail. This e-mail confirms the purchase agreement. The agreement will be considered to have been made in The Netherlands. Uppark reserves the right to break off the transaction process and/or to cancel it, if we deem it necessary.
 

Article 2 – Paying with iDEAL or credit card
Pre-payment can be done by iDEAL or credit card (Master card and Visa). By using a particular credit card you confirm that the credit card being used belongs to you. The amount due is automatically debited from your account, provided Uppark has accepted your order. All credit card holders are subject to checks and validation permission by the credit card company. Should your debit card's issuing authority refuse to give permission of payment to Uppark, then we will postpone the order and contact you. In that case Uppark is not responsible for any delay or non-delivery. Credit card details are processed using a SSL (Secure Sockets Layer) connection. Uppark is not responsible for misuse of these details by third parties.
 

The total price stated on the order and on the electronic order form includes postage. All prices listed on the web shop include BTW (VAT).
 

Article 3 – Delivery
The Netherlands
Uppark will do its best to send your purchase within a period of 2 working days. Uppark can not be held liable should the consignment take place at a later date. Uppark reserves the right to deliver the order up to 30 days after the order is placed and cannot be held liable for default by the client. The client will be informed should an order not be sent within 2 working days of placing an order.
Orders placed before 3pm Tuesday to Friday are sent the same day. Orders placed on Friday evening, Saturday and Sunday are sent on Tuesday. When we have processed the order, you will receive a mail from PostNL. This mail contains a Track & Trace number to enable you to follow the consignment.
 

All packages are sent with PostNL. Packages are sent with "signature for receipt home address (HVH)". That means that the package may not be delivered to the neighbours and that you must personally sign for receipt.

It is of course possible that you are not at home when the package is delivered. If this is the case PostNL will deliver the package the following day, except for Sundays. If you are again not at home, PostNL will put a note in the letterbox stating where the package can be collected. Usually this is the nearest post office.
 

In the Netherlands no shipment costs to your place or returning from your place on orders exceeding an amount of 100,- Euro.
On orders below an amount of Euro 100,- we have to charge you a shipment contribution of Euro 4,95.

Belgium and Germany
If you live in Belgium or Germany you can indicate this during the payment process.
In Belgium and Germany no shipment costs to your place on orders exceeding an amount of 100,- Euro.
On orders below an amount of Euro 100,- we have to charge you a shipment contribution of Euro 4,95.
 

Shipment costs, returning shoes from your place to us:
If you return shoes to change for others, there are no return shipment costs for you.
If you return shoes to be credited to you, a contribution in return shipment costs of Euro 4,95 will be charged to you.
 

In Belgium and Germany the package is left with the neighbours if you are not at home.
 

All other countries

If you live in a country outside the Netherlands, Belgium and Germany, you can indicate so
during the payment process.
 

Please indicate whether you live in “Other European Countries” (other than The Nertherlands, Belgium and Germany) or in “Countries Outside Europe”.
 

In “Other European Countries” we have to charge you a contribution in shipment costs to you
Of Euro 7,50. Returning shipment costs from your place back to us are on your own account,
they will be deducted from the purchase amount to be refunded to you.
 

In “Countries Outside Europe” we have to charge you a contribution in shipment costs to you
Of Euro 20,-. Returning shipment costs from your place back to us are on your own account,
they will be deducted from the purchase amount to be refunded to you.
 

It is possible that the postman leaves your package with your neighbours if you are not at home.
 

If your county is not in the list or for any other question, please contact us and we will discuss the possibilities with you.

Article 4 – Returning exchanging
 

Returning The Netherlands
If you are not satisfied with your purchase, you can return it up to 14 days after delivery of the goods. The only thing you have to do is to complete the form enclosed in the shoebox correctly and fully and stick the enclosed return-sticker over the shipping label. Then take the package to the nearest post office.
 

*Returned products are only accepted if:
1. The product is returned in the original packaging;
2. The product has not been used, damaged, worn or cleaned;
3. Labels are still attached to the product;
4. The instructions of use have been properly followed up.
 

Shoes may only be tried on indoors. If shoe soles are dirty, the return can not be accepted. Any free products sent by Uppark must also be returned. Products returned outside the above-mentioned period can be sent back to the purchaser without reimbursement. All carefully returned products will be credited. Uppark will refund the paid amount minus any shipping costs to the account number you have submitted.

Exchanging The Netherlands
If you wish to exchange the product for another product, another size or colour, you can indicate this on the attached return form. We ask you to send us an e-mail or to telephone customer service so that we can reserve the product for you. Shipping costs for exchanges are for the account of Uppark. If you wish to exchange a product a second time we ask a contribution in shipping costs of € 4.95. When we receive the return package you will be sent confirmation by e-mail. If there is a price difference as a consequence of exchanging, you will receive an e-mail with a request for additional payment or you will receive the price difference within 10 days on your account. Exchanges are only accepted if the conditions mentioned above have been adhered to.
 

Returning Belgium and Germany
If you are not satisfied with your purchase, you can return it up to 14 days after delivery of the goods. We ask for a contribution of € 4.95 for the returns.

The only thing you have to do is to complete the enclosed form correctly and send us an email that you wish to return your purchase. This can be sent to grotesque@uppark.nl. We will send you back an email with the return label enclosed. You have to stick the return label on the package and bring it to the post office. Uppark will refund the paid amount minus the contribution of € 4.95 to the account number you have submitted. Returns are only accepted if the conditions mentioned above have been adhered to.

Exchanges Belgium and Germany
Of course exchanges can also be done if you live in Belgium or Germany. First time changing, shipment costs back to us are on Uppark, changing products more than 1 time we have to charge you a contribution of € 4.95. If there is a price difference as a consequence of exchanging, you will receive an e-mail with a request for additional payment or you will receive the price difference within 10 days on your account. *Exchanges are only accepted if the conditions mentioned above have been adhered to.
 

Returns All other countries

Of course returns can also be sent from all other countries. Shipping costs from returns are fully for the account of the client. Returns are only accepted if the conditions mentioned above have been adhered to.

Article 6 – Information on the web shop
The information listed on grotesque.uppark.nl has been compiled with the greatest care and is continuously kept up to date. Nevertheless, we give no guarantee concerning the nature or content of information on this site and we cannot be held liable for the contents of this information or consequences arising from the use thereof. We can also not be held responsible or take any liability for access to any information to any site connect with or linked to uppark.nl. No rights can be derived from this internet site. Typographic and/or erroneous prices excepted. A product's colour can differ from the colour on a computer screen. Every computer screen is different, as also the screen settings. We will of course do our utmost to portray the real colour as well as possible.
 

Article 7 – Price policy with respect to sales
If you order a product at Uppark within 2 days before the start of a sale, we will adjust the product's price. This does not apply to products already discounted or products where an extra cash discount has been applied. All price adjustments approved by us will be refunded to the account number with which you paid your order.
 

Article 8 – Liability
The purchaser's liability is limited to the amount of the purchase price. Uppark can never be liable for any loss of profit or goodwill or any other consequential damages.
 

Article 9 – Applicable law and jurisdiction
Dutch law is applicable. Any dispute regarding a purchase and selling agreement which is subject to these conditions will be exclusively submitted to the court at Venlo, unless V.O.F. Uppark chooses to submit the dispute to the authorized judge in the purchaser's place of residence.
 

Article 10 – Complaints
If you have a complaint contact us by telephone on +31 (0)77 3231570 or send an e-mail to grotesque@uppark.nl. If you send an e-mail, don't forget to include your personal details, your order number and a clear description of your complaint. If it is a product complaint, please include a digital photo. We will judge your complaint on the basis of your description (and included photo) and you can expect us to contact you within 3 working days.
